Applicability of General Terms and Conditions

These General Terms and Conditions (GTC) apply to all contracts between Janin Klose – REFORMHER PILATES STUDIO (hereinafter "REFORMHER PILATES STUDIO", "REFORMHER" or "Studio") and its clients, unless otherwise agreed in individual cases. Clients within the meaning of these GTC are all natural persons who have received or receive the right to use the services offered by the Studio or to purchase the products offered.

Contract Formation

A binding contract is formed as soon as a booking for a service offered by REFORMHER, such as Reformer Pilates classes, is made via the booking portal on our website reformherstudio.de or via the Studio app and is confirmed by REFORMHER (§§ 145 et seq. German Civil Code). Confirmation by REFORMHER is made by sending a registration or payment confirmation via email or by contract signature. By making a booking, the client confirms that she has read, understood and accepted our GTC as well as the Studio guidelines. Changes to the GTC will be communicated to clients via email. Use of REFORMHER's services is permitted exclusively to persons aged 18 and over. By registering, the client confirms that she is of legal age.

2. Service Offering and Terms of Use

Type and Scope of Services Offered

REFORMHER offers various Reformer Pilates classes (self-guided or in groups) at different difficulty levels, personal training, as well as workshops and events. The Studio is entirely focused on women's training and wellbeing. Participation is possible through single or multiple-session cards, memberships or vouchers. All services are provided at REFORMHER PILATES STUDIO or in facilities rented for this purpose. The Studio does not guarantee that all training equipment or class spaces will be available at all times. Use is subject to current capacity and operationally feasible availability.

Opening Hours

Opening hours as well as the current class and event schedule can be viewed at any time on the website and in the Studio app and are regularly updated. REFORMHER is entitled to remain closed on public holidays as well as up to 10 additional days per year due to renovation work or other operationally necessary reasons. Clients are not entitled to a refund of class or membership fees in these cases. The relevant closure periods will be announced to clients in good time via the website or social media channels.

Changes to Service Offering

REFORMHER is entitled to adjust class schedules, class content and instructor assignments at any time. A class may be canceled at short notice if fewer than 4 participants are registered by no later than 12 hours before the class begins, or if organizational or health reasons (instructor illness or technical malfunctions) prevent the class from taking place. Similarly, REFORMHER may cancel an event if fewer than 5 participants are registered 7 days before the start, or if other organizational or health reasons make it impossible to conduct. In the event of a cancellation initiated by REFORMHER, the client receives a full refund. For classes, the booked credit is credited back; for events, the amount already paid is refunded.

3. Single and Multiple-Session Cards

Service Scope and Validity

REFORMHER offers single and multiple-session cards for booking the services offered. Attendance at a single Reformer Pilates class, personal training session, workshop or event can be booked via a single-session card. Multiple-session cards are available as 5-session and 10-session cards and entitle the holder to book individual Reformer Pilates classes and personal training sessions. Multiple-session cards cannot be used to book workshops and events. Purchasing a single or multiple-session card for Reformer Pilates classes entitles participation exclusively in the intended class type. Cards for group classes are valid exclusively for group classes; cards for On-Demand classes are redeemable exclusively for On-Demand classes. Exchange or transfer to other class types is not possible. The validity period of each single and multiple-session card is visible at the time of purchase.

Credits

Depending on the card selected, a certain number of credits are available to the client. The exact number of credits is indicated in the booking portal and upon contract conclusion. Unused credits expire after the validity period ends. Extension or refund of unused services is excluded.

Transferability

Multiple-session cards are personal, valid for one person each, and are generally non-transferable. An exception may be granted in individual cases, for example in the event of pregnancy, relocation or injury, after consultation with the Studio.

4. Memberships

Term and Renewal

REFORMHER offers memberships with a term of 3 months. These automatically renew for the respective period unless timely cancellation is made. Cancellation may be submitted in writing up to 14 days before the end of the 3-month period.

Contract Formation, Service Scope and Validity

The membership contract becomes effective upon contract conclusion via the online portal. The client may use REFORMHER's services to the agreed extent from the contract start date. Purchasing a membership entitles participation exclusively in the respective intended class type. Memberships for On-Demand classes can only be redeemed for On-Demand classes and are not transferable to other class types. Memberships cannot be used to book workshops and events. Members have the opportunity to bring a friend to training once per month. Guest participation must be announced to the Studio at least 6 hours before the respective class via email to info@reformherstudio.de.

Credits and Refunds

Depending on the membership selected, a certain number of credits are available to the client monthly, which can be used to book individual Reformer Pilates classes within the respective class type. The exact number of credits is indicated in the booking portal and upon contract conclusion. Unused credits expire at the end of the month and cannot be transferred or paid out. Refunds of fees already paid for unused periods are excluded.

Pause

Memberships may be paused provided the interruption lasts at least 7 consecutive days. The Studio must be informed in writing at least 7 days before the pause begins. Within a 3-month membership, a pause of up to 30 days in total may be granted. In the event of a pause, both the next payment and the end of the membership are postponed by the duration of the pause.

Change and Transferability

A change to another membership is possible at the beginning of the next billing period. Memberships are personal and non-transferable.

5. Bookings

Booking Platform

All bookings are made via the Glofox booking platform. In order to book a service with us, all clients must create a Glofox account and agree to Glofox's respective terms of use and privacy policies.

Participation

Prior booking via our booking portal on the website or via the Studio app is required for participation in classes and events. Participation is only guaranteed after full payment. Personal training sessions are considered appointments arranged individually via email. For all classes offered by REFORMHER, only one booking per client per day is permitted. This applies to both single and multiple-session cards as well as memberships.

Waiting List

If a class or event is already fully booked, the client can be placed on the waiting list. A place on the waiting list does not constitute a claim to participation! If a spot becomes available, it will be assigned to the person who confirms it first on a binding basis.

6. Prices, Payment Terms, Set-off

Price List

The prices valid at the time of booking apply, as displayed on the website, in the Studio app or on-site at the Studio. REFORMHER reserves the right to change prices and contents of the price list at any time with effect for future bookings. Contracts already concluded, such as single or multiple-session cards and memberships, remain unaffected by price changes unless otherwise agreed.

Payment Methods

Payments are made primarily online via the payment methods offered in the booking portal (e.g. card payment, direct debit). Cash payments for the purchase of single and multiple-session cards as well as vouchers are permitted in the Studio.

Due Date of Fees

Unless otherwise agreed, all participation fees and contributions are due upon contract conclusion. For memberships, the membership fee is to be paid monthly. In the event of payment default, access to bookings may be blocked. Refunds of cards or contributions already paid are excluded unless a different agreement exists or the Studio cancels classes or changes the offer.

Terms for Vouchers and Promotions

Discounts, vouchers and special promotions are only valid for the specified period and cannot be combined within one booking. Vouchers are only accepted in original form and are non-transferable.

Set-off

Set-off by the client is only permitted if her counterclaim is undisputed or legally established.

7. Non-Participation and Cancellation

Cancellation, Termination, Non-Appearance

Classes, personal training sessions, workshops and events can be canceled free of charge up to 12 hours before the start. After that, there is no entitlement to a refund. In the event of termination or non-appearance for a booked service, the credit expires for single cards and is recorded as used for multiple-session cards and memberships. Group class participants who do not arrive on time at the start of the class cannot participate in the class for safety reasons. The booking expires without entitlement to refund or rebooking.

Statutory Cancellation and Withdrawal Rights

Regardless of the regulations set out in these GTC, the customer's statutory cancellation and withdrawal rights remain unaffected.

Extraordinary Termination for Good Cause

Both REFORMHER and the client are entitled to terminate the contractual relationship extraordinarily without notice for good cause. Good cause exists in particular when one of the contracting parties cannot reasonably be expected to continue the contract. REFORMHER is entitled to terminate the contract extraordinarily if the client behaves in breach of contract or disruptively, fails to fulfill her payment obligation despite a reminder, or violates the house rules or safety regulations. With the effectiveness of the termination, the client's claim to participate in classes and her access to all Studio offerings expires. In the event of termination by the Studio for good cause for which the client is responsible, there is no claim to refund of fees already paid. Good cause on the part of the client exists in particular in the case of proven permanent illness or injury, permanent relocation, pregnancy, or significant breach of duty by the Studio. The termination must be made in writing stating the reason. REFORMHER is entitled to request appropriate proof (e.g. medical certificate or registration certificate). In the event of justified extraordinary termination by the client, REFORMHER is obliged to refund services already paid for but not yet used on a pro-rata basis. Refunds are generally only made for periods after the termination becomes effective.

8. Sale of Goods

Product Range and Prices

In addition to classes and events, REFORMHER offers goods for sale, particularly merchandise items. Goods may only be purchased in the Studio. Prices include the applicable value-added tax.

Returns and Complaints

Refunds or exchanges are excluded unless the goods are defective. Complaints regarding defects must be reported immediately on-site or via email to REFORMHER. Warranty claims do not exist for damage or defects resulting from improper use, wear and tear, or normal deterioration.

9. Liability & Health

Health Status of Clients

Participation in all classes, training sessions and events offered by REFORMHER is at one's own responsibility. By booking, the client confirms that she is physically healthy and capable of meeting the requirements of the respective training session. Any health restrictions, injuries or pregnancies must be communicated to the instructors before the class begins. If in doubt, it is recommended to seek medical advice before participation.

Limitation of Liability

The Studio is not liable for damage arising from improper use of equipment, disregard of instructors' instructions, or the client's own fault. Damage caused by clients to REFORMHER's property or facilities must be compensated. Lockers are available exclusively during training time. In case of misuse, REFORMHER is entitled to have the locker opened at the client's expense. No liability is assumed for items brought along, especially valuables.

Liability for Intent and Gross Negligence

REFORMHER and its vicarious agents are only liable in cases of intent or gross negligence. In cases of slight negligence, REFORMHER is only liable if an essential contractual obligation (cardinal duty) has been violated, and then exclusively for foreseeable, contract-typical damages.

10. Copyright

Protection of Content

All content published or made available within our Studio, particularly class concepts, training materials, images and videos, is protected by copyright. All rights remain reserved by the Studio or the respective rights holders.

Use of Content

Any use of this content without our prior written consent is prohibited. This includes in particular reproduction, distribution, public performance, transfer to third parties, and any form of commercial use.

Contractual Penalty for Violations

Violations will be penalized with a contractual penalty of €3,000.

11. Data Protection & Image Use

Use of Personal Data

Personal data of clients is used by REFORMHER exclusively for contract processing, class booking and communication.

Photo and Video Recordings

REFORMHER may produce photo and video recordings during classes, workshops or events for advertising and documentation purposes, provided participants have given their express prior consent. Consent is provided free of charge and may be revoked in writing or via email at any time.

12. Right of Withdrawal

Scope

Consumers have a statutory right of withdrawal of 14 days for single and multiple-session cards as well as memberships purchased online. The right of withdrawal comes into effect upon conclusion of the contract and may be exercised without giving reasons.

Exercise of Withdrawal

To exercise the right of withdrawal, the client must inform the Studio (Janin Klose – REFORMHER PILATES STUDIO, Carrierastraße 17, 01139 Dresden, Email: info@reformherstudio.de) in writing by letter or email that she wishes to withdraw from the contract. Following effective withdrawal, REFORMHER will refund all amounts already paid for services not yet rendered within 14 days using the payment method used for booking, unless otherwise agreed.

Exclusion of Right of Withdrawal and Proportionate Payment

The right of withdrawal expires if the client has already started using REFORMHER's service offering within the period and it has been fully rendered. If the client has expressly requested that services begin during the withdrawal period, she must pay a proportionate amount for the portion already rendered. The amount is determined by the ratio of services rendered up to the time of withdrawal to the total scope of agreed services.

13. Final Provisions


(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) For all disputes arising from the contractual relationship between the client and REFORMHER, the place of jurisdiction is Dresden.

(3) Should individual provisions of these GTC be wholly or partially invalid or unenforceable, the validity of the remaining provisions remains unaffected.

(4) REFORMHER reserves the right to amend or supplement these GTC in writing, particularly in the case of adjustments to legal requirements, changed business processes or technical innovations. Clients will be informed of changes to the GTC via the website, the Studio app or by email. Changes take effect 4 weeks after announcement.

Applicability of General Terms and Conditions

These General Terms and Conditions (GTC) apply to all contracts between Janin Klose – REFORMHER PILATES STUDIO (hereinafter "REFORMHER PILATES STUDIO", "REFORMHER" or "Studio") and its clients, unless otherwise agreed in individual cases. Clients within the meaning of these GTC are all natural persons who have received or receive the right to use the services offered by the Studio or to purchase the products offered.

Contract Formation

A binding contract is formed as soon as a booking for a service offered by REFORMHER, such as Reformer Pilates classes, is made via the booking portal on our website reformherstudio.de or via the Studio app and is confirmed by REFORMHER (§§ 145 et seq. German Civil Code). Confirmation by REFORMHER is made by sending a registration or payment confirmation via email or by contract signature. By making a booking, the client confirms that she has read, understood and accepted our GTC as well as the Studio guidelines. Changes to the GTC will be communicated to clients via email. Use of REFORMHER's services is permitted exclusively to persons aged 18 and over. By registering, the client confirms that she is of legal age.

2. Service Offering and Terms of Use

Type and Scope of Services Offered

REFORMHER offers various Reformer Pilates classes (self-guided or in groups) at different difficulty levels, personal training, as well as workshops and events. The Studio is entirely focused on women's training and wellbeing. Participation is possible through single or multiple-session cards, memberships or vouchers. All services are provided at REFORMHER PILATES STUDIO or in facilities rented for this purpose. The Studio does not guarantee that all training equipment or class spaces will be available at all times. Use is subject to current capacity and operationally feasible availability.

Opening Hours

Opening hours as well as the current class and event schedule can be viewed at any time on the website and in the Studio app and are regularly updated. REFORMHER is entitled to remain closed on public holidays as well as up to 10 additional days per year due to renovation work or other operationally necessary reasons. Clients are not entitled to a refund of class or membership fees in these cases. The relevant closure periods will be announced to clients in good time via the website or social media channels.

Changes to Service Offering

REFORMHER is entitled to adjust class schedules, class content and instructor assignments at any time. A class may be canceled at short notice if fewer than 4 participants are registered by no later than 12 hours before the class begins, or if organizational or health reasons (instructor illness or technical malfunctions) prevent the class from taking place. Similarly, REFORMHER may cancel an event if fewer than 5 participants are registered 7 days before the start, or if other organizational or health reasons make it impossible to conduct. In the event of a cancellation initiated by REFORMHER, the client receives a full refund. For classes, the booked credit is credited back; for events, the amount already paid is refunded.

3. Single and Multiple-Session Cards

Service Scope and Validity

REFORMHER offers single and multiple-session cards for booking the services offered. Attendance at a single Reformer Pilates class, personal training session, workshop or event can be booked via a single-session card. Multiple-session cards are available as 5-session and 10-session cards and entitle the holder to book individual Reformer Pilates classes and personal training sessions. Multiple-session cards cannot be used to book workshops and events. Purchasing a single or multiple-session card for Reformer Pilates classes entitles participation exclusively in the intended class type. Cards for group classes are valid exclusively for group classes; cards for On-Demand classes are redeemable exclusively for On-Demand classes. Exchange or transfer to other class types is not possible. The validity period of each single and multiple-session card is visible at the time of purchase.

Credits

Depending on the card selected, a certain number of credits are available to the client. The exact number of credits is indicated in the booking portal and upon contract conclusion. Unused credits expire after the validity period ends. Extension or refund of unused services is excluded.

Transferability

Multiple-session cards are personal, valid for one person each, and are generally non-transferable. An exception may be granted in individual cases, for example in the event of pregnancy, relocation or injury, after consultation with the Studio.

4. Memberships

Term and Renewal

REFORMHER offers memberships with a term of 3 months. These automatically renew for the respective period unless timely cancellation is made. Cancellation may be submitted in writing up to 14 days before the end of the 3-month period.

Contract Formation, Service Scope and Validity

The membership contract becomes effective upon contract conclusion via the online portal. The client may use REFORMHER's services to the agreed extent from the contract start date. Purchasing a membership entitles participation exclusively in the respective intended class type. Memberships for On-Demand classes can only be redeemed for On-Demand classes and are not transferable to other class types. Memberships cannot be used to book workshops and events. Members have the opportunity to bring a friend to training once per month. Guest participation must be announced to the Studio at least 6 hours before the respective class via email to info@reformherstudio.de.

Credits and Refunds

Depending on the membership selected, a certain number of credits are available to the client monthly, which can be used to book individual Reformer Pilates classes within the respective class type. The exact number of credits is indicated in the booking portal and upon contract conclusion. Unused credits expire at the end of the month and cannot be transferred or paid out. Refunds of fees already paid for unused periods are excluded.

Pause

Memberships may be paused provided the interruption lasts at least 7 consecutive days. The Studio must be informed in writing at least 7 days before the pause begins. Within a 3-month membership, a pause of up to 30 days in total may be granted. In the event of a pause, both the next payment and the end of the membership are postponed by the duration of the pause.

Change and Transferability

A change to another membership is possible at the beginning of the next billing period. Memberships are personal and non-transferable.

5. Bookings

Booking Platform

All bookings are made via the Glofox booking platform. In order to book a service with us, all clients must create a Glofox account and agree to Glofox's respective terms of use and privacy policies.

Participation

Prior booking via our booking portal on the website or via the Studio app is required for participation in classes and events. Participation is only guaranteed after full payment. Personal training sessions are considered appointments arranged individually via email. For all classes offered by REFORMHER, only one booking per client per day is permitted. This applies to both single and multiple-session cards as well as memberships.

Waiting List

If a class or event is already fully booked, the client can be placed on the waiting list. A place on the waiting list does not constitute a claim to participation! If a spot becomes available, it will be assigned to the person who confirms it first on a binding basis.

6. Prices, Payment Terms, Set-off

Price List

The prices valid at the time of booking apply, as displayed on the website, in the Studio app or on-site at the Studio. REFORMHER reserves the right to change prices and contents of the price list at any time with effect for future bookings. Contracts already concluded, such as single or multiple-session cards and memberships, remain unaffected by price changes unless otherwise agreed.

Payment Methods

Payments are made primarily online via the payment methods offered in the booking portal (e.g. card payment, direct debit). Cash payments for the purchase of single and multiple-session cards as well as vouchers are permitted in the Studio.

Due Date of Fees

Unless otherwise agreed, all participation fees and contributions are due upon contract conclusion. For memberships, the membership fee is to be paid monthly. In the event of payment default, access to bookings may be blocked. Refunds of cards or contributions already paid are excluded unless a different agreement exists or the Studio cancels classes or changes the offer.

Terms for Vouchers and Promotions

Discounts, vouchers and special promotions are only valid for the specified period and cannot be combined within one booking. Vouchers are only accepted in original form and are non-transferable.

Set-off

Set-off by the client is only permitted if her counterclaim is undisputed or legally established.

7. Non-Participation and Cancellation

Cancellation, Termination, Non-Appearance

Classes, personal training sessions, workshops and events can be canceled free of charge up to 12 hours before the start. After that, there is no entitlement to a refund. In the event of termination or non-appearance for a booked service, the credit expires for single cards and is recorded as used for multiple-session cards and memberships. Group class participants who do not arrive on time at the start of the class cannot participate in the class for safety reasons. The booking expires without entitlement to refund or rebooking.

Statutory Cancellation and Withdrawal Rights

Regardless of the regulations set out in these GTC, the customer's statutory cancellation and withdrawal rights remain unaffected.

Extraordinary Termination for Good Cause

Both REFORMHER and the client are entitled to terminate the contractual relationship extraordinarily without notice for good cause. Good cause exists in particular when one of the contracting parties cannot reasonably be expected to continue the contract. REFORMHER is entitled to terminate the contract extraordinarily if the client behaves in breach of contract or disruptively, fails to fulfill her payment obligation despite a reminder, or violates the house rules or safety regulations. With the effectiveness of the termination, the client's claim to participate in classes and her access to all Studio offerings expires. In the event of termination by the Studio for good cause for which the client is responsible, there is no claim to refund of fees already paid. Good cause on the part of the client exists in particular in the case of proven permanent illness or injury, permanent relocation, pregnancy, or significant breach of duty by the Studio. The termination must be made in writing stating the reason. REFORMHER is entitled to request appropriate proof (e.g. medical certificate or registration certificate). In the event of justified extraordinary termination by the client, REFORMHER is obliged to refund services already paid for but not yet used on a pro-rata basis. Refunds are generally only made for periods after the termination becomes effective.

8. Sale of Goods

Product Range and Prices

In addition to classes and events, REFORMHER offers goods for sale, particularly merchandise items. Goods may only be purchased in the Studio. Prices include the applicable value-added tax.

Returns and Complaints

Refunds or exchanges are excluded unless the goods are defective. Complaints regarding defects must be reported immediately on-site or via email to REFORMHER. Warranty claims do not exist for damage or defects resulting from improper use, wear and tear, or normal deterioration.

9. Liability & Health

Health Status of Clients

Participation in all classes, training sessions and events offered by REFORMHER is at one's own responsibility. By booking, the client confirms that she is physically healthy and capable of meeting the requirements of the respective training session. Any health restrictions, injuries or pregnancies must be communicated to the instructors before the class begins. If in doubt, it is recommended to seek medical advice before participation.

Limitation of Liability

The Studio is not liable for damage arising from improper use of equipment, disregard of instructors' instructions, or the client's own fault. Damage caused by clients to REFORMHER's property or facilities must be compensated. Lockers are available exclusively during training time. In case of misuse, REFORMHER is entitled to have the locker opened at the client's expense. No liability is assumed for items brought along, especially valuables.

Liability for Intent and Gross Negligence

REFORMHER and its vicarious agents are only liable in cases of intent or gross negligence. In cases of slight negligence, REFORMHER is only liable if an essential contractual obligation (cardinal duty) has been violated, and then exclusively for foreseeable, contract-typical damages.

10. Copyright

Protection of Content

All content published or made available within our Studio, particularly class concepts, training materials, images and videos, is protected by copyright. All rights remain reserved by the Studio or the respective rights holders.

Use of Content

Any use of this content without our prior written consent is prohibited. This includes in particular reproduction, distribution, public performance, transfer to third parties, and any form of commercial use.

Contractual Penalty for Violations

Violations will be penalized with a contractual penalty of €3,000.

11. Data Protection & Image Use

Use of Personal Data

Personal data of clients is used by REFORMHER exclusively for contract processing, class booking and communication.

Photo and Video Recordings

REFORMHER may produce photo and video recordings during classes, workshops or events for advertising and documentation purposes, provided participants have given their express prior consent. Consent is provided free of charge and may be revoked in writing or via email at any time.

12. Right of Withdrawal

Scope

Consumers have a statutory right of withdrawal of 14 days for single and multiple-session cards as well as memberships purchased online. The right of withdrawal comes into effect upon conclusion of the contract and may be exercised without giving reasons.

Exercise of Withdrawal

To exercise the right of withdrawal, the client must inform the Studio (Janin Klose – REFORMHER PILATES STUDIO, Carrierastraße 17, 01139 Dresden, Email: info@reformherstudio.de) in writing by letter or email that she wishes to withdraw from the contract. Following effective withdrawal, REFORMHER will refund all amounts already paid for services not yet rendered within 14 days using the payment method used for booking, unless otherwise agreed.

Exclusion of Right of Withdrawal and Proportionate Payment

The right of withdrawal expires if the client has already started using REFORMHER's service offering within the period and it has been fully rendered. If the client has expressly requested that services begin during the withdrawal period, she must pay a proportionate amount for the portion already rendered. The amount is determined by the ratio of services rendered up to the time of withdrawal to the total scope of agreed services.

13. Final Provisions


(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) For all disputes arising from the contractual relationship between the client and REFORMHER, the place of jurisdiction is Dresden.

(3) Should individual provisions of these GTC be wholly or partially invalid or unenforceable, the validity of the remaining provisions remains unaffected.

(4) REFORMHER reserves the right to amend or supplement these GTC in writing, particularly in the case of adjustments to legal requirements, changed business processes or technical innovations. Clients will be informed of changes to the GTC via the website, the Studio app or by email. Changes take effect 4 weeks after announcement.
